Violation Process
FLORIDA STATUE- 720.305
Step # 1 - Courtesy Notice
Notice mailed to the current owner's address on file and to tenant if applicable. Notice will state the violation with correction to be completed within two (2) weeks from the date of the notice.
Step #2 - Unresolved Violation
Notice of Imposed Fine If within two (2) weeks from the date of the Courtesy Notice, there has been no action to comply or written contact to Madison Solutions, (our HOA Management Company) and the violation remains unresolved, a certified letter will be sent stating that the violator will have (14) fourteen days to request a hearing in front of the Rules Compliance Committee (RCC) to dispute the validity of the fine.
Step #3 - Unresolved Violation
Rules Compliance Committee - Fining If the violator requests a hearing, they will be afforded an opportunity to appear in front of the Rules Compliance Committee to dispute the validity of the fine being imposed. The Committee will then determine to impose the fine levied by the Association Board or overturn the fine, at which point the matter ends and the fine is no longer actionable
If the violator fails to request a hearing, for any reason, the fine can be imposed immediately at the end of the (14) day period.
Correspondence with Action Plan
If within two (2) weeks from the date of the Courtesy Notice, a homeowner contacts Elim Services with a plan of action and completion date, the Association will provide a written verification of acceptance or denial of the action plan. The written verification will inform the owner that if the action plan is not completed by the time frame stipulated or is not an acceptable plan, the unit will be sent to the RCC with possible assessment of fine.

If within two (2) weeks from the stipulated plan of action completion date, the violation is not corrected, the Association will send a certified letter to the homeowner. See Step #3
Fines
Fines will be imposed at a $ 100.00 daily per violation. The total fine for any one violation cannot exceed $1,000.00
